You agree to indemnify, defend, and hold harmless Tradie Radar and its affiliates, officers, directors, employees, agents, and third-party service providers from and against any claims, damages, liabilities, costs, and expenses, including reasonable attorneys' fees, arising out of or related to your use of our services or your violation of these Terms and Conditions.

15. Governing Law

These Terms and Conditions shall be governed and construed in accordance with the laws of the state of New South Wales, Australia, without regard to its conflict of law provisions.

16. Dispute Resolution

Any dispute arising out of or related to these Terms and Conditions or your use of our services shall be resolved through informal negotiation between the parties. If the parties are unable to resolve the dispute through negotiation, then the dispute shall be submitted to mediation in accordance with the rules of the Australian Centre for International Commercial Arbitration. If mediation is unsuccessful, then the dispute shall be submitted to binding arbitration in accordance with the rules of the same organization. Any judgment or award entered by the arbitrator shall be final and binding on the parties and may be entered in any court having jurisdiction thereof.

18. Defamation: The Customer agrees not to engage in any conduct that could be considered defamatory, libelous or slanderous towards Tradie Radar or its employees, contractors, or agents. The Customer acknowledges and agrees that Tradie Radar has the right to seek legal remedies if the Customer engages in such conduct, and the Customer shall indemnify and hold harmless Tradie Radar from any damages, costs, or expenses resulting from such conduct.

19. Tradie Radar is not responsible for any problems, damages, or losses that result from the client's use of the website hosting and development services, including but not limited to website crashes, data loss, or security breaches. The client agrees to take full responsibility for any actions they take that may affect the hosting or performance of their website, and releases Tradie Radar from any liability for such actions.

20. The Client agrees not to use Tradie Radar's website hosting and email hosting services for any illegal activity or in a manner that infringes on any third party's intellectual property rights. The Client acknowledges that Tradie Radar will not be held responsible for any damages or losses resulting from the Client's illegal activity or infringement. Tradie Radar reserves the right to suspend or terminate the Client's account if such activity is discovered.

21. Confidentiality: Any information shared between the Client and Tradie Radar is confidential and must not be disclosed to any third party without the express written consent of Tradie Radar. The Client agrees that any breach of this confidentiality clause will result in a breach of contract and may result in legal action, including but not limited to financial damages and injunctive relief.

22. Please note that it is the responsibility of the client to carefully read and understand all terms and conditions outlined in any contracts, agreements, or advertising materials provided by Tradie Radar. Failure to do so does not negate the client's obligation to adhere to these terms and conditions.
